These Terms govern your use of the Dominant Tires website and purchases from Dominant Tires. By using the site or placing an order, you agree to these Terms and the policies referenced here. If you do not agree, please do not use the Services.
1. About us and eligibility
Dominant Tires is an independent tire retailer based in New York and operated by BMS WORKS INC. You must be legally able to enter into a binding contract, or use the site with appropriate parental or guardian authorization. Provide accurate contact, billing, and delivery information and keep account credentials confidential.
2. Product information and compatibility
We aim to present accurate descriptions, images, prices, and availability. Images may illustrate a tire model; appearance can vary by size. Read the selected variant and package quantity carefully. Wheels and installation are excluded unless expressly included.
Search tools, categories, and educational content help narrow choices but do not replace complete fitment verification. Check the vehicle manufacturer's specifications, tire size, load and speed requirements, wheel compatibility, and any modifications. Have a qualified installer verify the tires before mounting. Contact us about inconsistencies before ordering.
3. Orders, prices, and payment
Prices are in U.S. dollars unless otherwise shown. The checkout displays the product total, applicable taxes, and any disclosed charges before purchase. We do not add handling fees. Promotions have their stated conditions and cannot be applied retroactively unless expressly offered.
An order confirmation acknowledges receipt of your order. Acceptance and fulfillment remain subject to successful payment, availability, and necessary verification. We may contact you to correct an error or decline an order for a legitimate reason, including unavailable inventory, suspected fraud, or a material listing error. If an order cannot be fulfilled, amounts collected for the affected items will be refunded. We will not substitute a different tire or impose a higher price without your agreement.
4. Shipping and cancellation
We offer free shipping only to eligible street addresses in the 48 contiguous U.S. states. Estimated delivery is within 3 business days after order confirmation, including normal processing and transit, counted in Eastern Time and excluding weekends, U.S. federal holidays and their observed dates. This is an estimate, not a guaranteed arrival deadline. Our Shipping & Delivery policy explains destination exclusions, tracking, separate packages and factors that may affect timing. Contact us immediately for a change or cancellation; fulfillment may already be underway. Your rights under applicable law remain unaffected.
5. Returns and refunds
Our 90-Day Returns policy describes eligibility, authorization, shipping responsibility, and refunds. Inspect tires before installation. Do not send a return to our headquarters or a supplier without the return instructions we provide.
6. Installation, use, and warranties
Tires must be professionally installed and used according to vehicle and tire manufacturer instructions. You are responsible for services you arrange with an independent installer. Any manufacturer warranty is subject to its written terms and purchase eligibility. See Tire Warranty Support. No wording here excludes rights or warranties that cannot lawfully be excluded.
7. Website content and intellectual property
Our site content, branding, and design are protected by applicable intellectual property laws. You may use the site for personal shopping and information, but may not copy or commercially exploit protected material without permission. Third-party trademarks belong to their owners; references identify products and do not imply an affiliation or manufacturer endorsement.
8. Acceptable use
Do not use the site for unlawful activities, fraudulent orders, harassment, infringement, malicious code, unauthorized access, scraping that disrupts the service, or interference with other users. We may restrict access where reasonably necessary to protect the Services or comply with law.
9. External services and links
The store uses Shopify and may link to payment, carrier, manufacturer, or other third-party services. Their own terms and privacy practices apply to their services. A link does not guarantee the accuracy of third-party content.
10. Feedback and communications
You are responsible for material you submit. Do not submit confidential information, unlawful content, or material that violates another person's rights. We may use feedback you choose to provide to improve the store. Any display of a customer review must reflect the customer's experience and applicable consent.
11. Privacy
Mobile opt-in data and SMS consent are never shared with anyone for any purpose. All general information-sharing descriptions in these Terms and our Privacy Policy exclude mobile opt-in data and SMS consent.
Shopify hosts our store and processes personal information when you visit or make purchases. Shopify Network Intelligence uses information from interactions with this store, other merchants and Shopify to provide enhanced services, including personalization and advertising. Information is shared with Shopify and other service providers, which may be located in other countries, to provide these services. Our Privacy Policy explains this processing, available choices and privacy rights. Marketing preferences are separate from essential order and service communications.
12. Service availability and liability
We work to keep the site available and accurate, but cannot promise uninterrupted operation or that every page is error-free. To the extent permitted by applicable law, we are not liable for indirect or consequential losses arising from use of the website. This provision does not exclude liability for fraud, willful misconduct, personal injury where exclusion is prohibited, or other rights and remedies that cannot lawfully be limited.
13. Governing law and disputes
These Terms are governed by New York law, subject to applicable mandatory consumer protections. Please contact us first about a concern so we can try to resolve it. Nothing here requires you to waive rights or access to a forum that applicable law guarantees.
14. Changes and general terms
We may update these Terms by posting a revised version with a new date. The terms applicable to a purchase are those in effect when the order is placed, except where a change is required by law or separately agreed. If a provision is unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver.

Dominant Tires Customer Care SMS Terms and Conditions
Program and business identity. The Dominant Tires Customer Care SMS Program is operated by BMS WORKS INC. under the Dominant Tires brand. Customer-care messages are sent from (888) 338-0038. Messages answer tire and fitment questions and provide assistance with orders, delivery, returns, and other support requests. This program does not include promotional or marketing texts.
Optional opt-in. To request text support through our contact form, enter your mobile number, choose the optional Yes option authorizing customer-care texts from Dominant Tires, and submit your request. No SMS consent option is selected in advance. You can choose No or leave the SMS choice unanswered and receive assistance by email instead. You may also start a customer-care text conversation directly with us; our replies relate to your question and support request.
Providing a phone number alone, placing an order, signing up for email updates, or accepting the website Terms does not enroll you in this SMS program. Consent to receive text messages is voluntary and is not a condition of purchase.
Frequency and rates. Message frequency varies based on communication needs and your support requests. Message and data rates may apply to messages sent to you and to messages you send us. Contact your wireless provider if you have questions about your text or data plan.
Cancel at any time. Text STOP to (888) 338-0038 or to the number from which you received our messages. We will send a confirmation that you have been unsubscribed; after that confirmation, you will no longer receive messages from this SMS program unless you opt in again. To rejoin, provide a new affirmative opt-in using the same signup process. Contact us if you need help restarting text support.

Carrier delivery. Carriers are not liable for delayed or undelivered messages.
